Then, participants were randomly assigned to either watch their own video or a female study confederate’s video, whom participants believed to be the previous study participant. After watching the storytelling video, participants completed an 8-item measure of how they felt while watching the (self or peer) video, which served as our primary measure of compassionate feelings. Specifically, participants rated eight feeling adjectives [relaxed, happy, sad (reverse-scored), proud, embarrassed (reverse-scored), irritable (reverse-scored), nervous (reverse-scored), peaceful] using 7-point Likert scales (1 = not at all to 7 = extremely). These items were summed to create a composite measure of compassionate feelings toward the self or other video (α = 0.83), with higher scores referencing higher compassionate feelings. Importantly, by asking participants, “How did you feel while watching your [the] video?” we were able to specifically probe feelings of self-compassion (or other-directed compassion) in response to this mildly embarrassing, impromptu storytelling playback. More positive feelings result from feelings of compassion, and less positive feelings reflect negative judgments and a critical response to the video. To evaluate the specificity of the self-compassionate feelings account, participants also completed a 9-item measure of their social perceptions in response to watching the storytelling video (see Leary et al., 2007, Study 4). Participants were asked to rate how they (or the peer) appeared in the video on nine performance dimensions [awkward (reverse-scored), confident, nervous (reverse-scored), creative, reasonable, competent, attractive, foolish (reverse-scored), likable] using 7-point Likert scales (1 = not at all to 7 = extremely) in response to the question, “How do you think you [the other participant] appeared on the video?” Like the compassionate feelings composite measure, the nine items were summed to create a composite measure of performance perceptions toward the self or other video (α = 0.83), with higher scores referencing higher social perceptions of performance during the storytelling task. Thus, we were able to measure two distinct aspects of self-compassion (and other-directed compassion): feelings of (self-) compassion and performance perceptions in response to the storytelling video. These behavioral ratings of self-compassion are positively related to trait self-compassion in previous work (Leary et al., 2007, Study 4). Participants completed a final demographics measure before being probed for suspicion, fully debriefed, and dismissed.
My question is: Can I serve my soon to be ex-wife a Discovery request even though I’m pro se and representing myself? I was served with a request from her attorney after our hearing for temporary alimony and child support and I want to counter act with a request as well. Her attorney is taking full advantage of my pro se circumstances and incompetent knowledge of divorce law as she should. I don’t want this to be an easy win for her when I have evidence that can work in my favor. I just need to find the best way to get it in front of the judge without being bullied in the court room. I don’t know my rights as a pro se litigant and I need as much advice as possible. I picked up her financial affidavit from the clerks office and she’s leaving out a lot of income that needs to be uncovered in my case. The issue is being overwhelmed by all of her attorney deadlines and demands which sidetracks my course of action to respond in my defense appropriately.
Eighty percent of state criminal defendants cannot afford to pay for a lawyer, and only those who are actually incarcerated are constitutionally entitled to appointed counsel. Many people facing misdemeanor charges can, if convicted, be subjected to significant fines and fees, or face the loss of benefits (including housing) or deportation. Yet, they have no right to an attorney, and those who cannot afford a lawyer will go without one.
Yet the world of the ship is also a land of gab. Conversations and wheeling and dealing break out constantly. There’s a kind of aspirational sociability to life among strangers. It’s always possible that you’re walking into a den of thieves, but it’s more likely that most people are basically decent. If we took a position of total mistrust, we’d all wind up staying in our rooms the whole time to avoid getting fleeced or stabbed. There has to be some baseline level of confidence for exchange to occur, or even for people to just get along and pick up a story or two. Melville’s character hits people where they’re most vulnerable: by trying to act decently, by trying to follow humane norms of behavior, they end up suckers. A minister, for instance, denounces the embittered fellow who says a cripple is an imposter in blackface and gives the beggar a coin (rather than throwing it in his mouth, the cruel sport of the other guests). For his trouble he is rewarded with a visit from a man in gray, who praises him and says, “Since you are of this truly charitable nature, you will not turn away an appeal in behalf of the Seminole Widow and Orphan Asylum?” But the cynics don’t fare any better: a stingy miser buys some herbal concoction in the hope that it will soothe his pain, and a misanthrope who’d rather have machines than boys work his farm agrees to take on a lad from another smooth operator’s Philosophical Intelligence Office, a kind of antebellum temp agency. The confidence-man worms his way into the pockets of trusting and suspicious passengers alike.
[p]ro se litigation is difficult for us to handle at least in part because it doesn’t fit into the neat box of our traditional system of litigation, the adversarial method of resolving disputes. That system assumes that the parties know the law, are adept at procedure and the rules of evidence, and can marshal significant facts, present their side of the case to the factfinder thoroughly and lance the arguments of the opponent. But pro se litigants are capable of little if any of that.
Like the self-resources account, our findings indicate that self-affirmation boosts one’s self-image by increasing positive self-feelings, but provide additional specificity about the nature of these feelings; self-affirmation increases feelings related to self-compassion (e.g., sympathy, trust, and less criticism; Study 1). Like self-esteem, self-compassion predicts positive feeling states, but is distinguished by its more stable relationship to self-worth, independent of positive or negative outcomes (Neff and Vonk, 2009). Consistent with this, in response to a potentially embarrassing video of oneself, affirmed participants maintained positive self-feelings (Study 2). The effect of self-affirmation writing on self-compassion may explain why few studies have shown that self-affirmation increases general feelings of state self-esteem or positive affectivity (Sherman and Cohen, 2006).

Their rights notwithstanding, pro se litigants create many obstacles for our judicial system as a whole. Indeed, pro se lawsuits are viewed by many as “a type of litigation that’s just riddled with problems on every level.” Lois Bloom, Statement at Pro Se Litigation Panel Discussion, National Workshop for District Judges I (Fed. Judicial Ctr. Mar. 22, 1995). As one commentator has stated,
Most family divisions of the Vermont Superior Court offer a one-hour program each month. Other divisions offer them quarterly. A lawyer who practices in the family division conducts the program. The lawyer cannot talk to you about the specifics of your case. Instead, you will receive general information about the law and the process. See the schedule below for the county in which you filed your action.
Alternatively, as suggested by previous theorizing and research (Sherman and Cohen, 2006), we tested whether changes in overall state positive affect could explain increased helping behavior (Isen and Levin, 1972). We created a composite measure of state positive affect (five items: hopeful, secure, joyful, confident, and open; pre α = 0.77, post α = 0.84) before and after the affirmation writing manipulation. The self-affirmation group did not have greater increases in general positive affect [as assessed by a one-way ANOVA on the composite state positive affect change score: F(1,50) = 0.05, p = 0.83] compared to the control group, indicating that changes in state positive affect is not a viable mediator.
The Sixth Amendment guarantees criminal defendants the right to representation by counsel. In 1975, the Supreme Court held that the structure of the Sixth Amendment necessarily implies that a defendant in a state criminal trial has a constitutional right to proceed without counsel when he voluntarily and intelligently elects to do so. See Faretta v. California, 422 U.S. 806 (1975). Thus, an unwilling defendant may not be compelled by the State to accept the assistance of a lawyer. A defendant's right to self-represenatation in federal criminal proceedings is codified in 28 U.S.C. § 1654.
Aside from her family appellate matters, Christa has also been successful in small claims. “I’m assuming you’re a lawyer, my friend. So I’m curious about your language and the notion that our commentary here represents “far more” of a disservice to pro se litigants than do lawyers. You’ve got a pretty low opinion of your profession.” See, this is exactly the kind of crap I’m talking about, and what’s worse is that you can literally read the entire entry that I wrote and see that I did NOT write that the commentary here represents more of a disservice to pro se litigants than lawyers do a disservice to pro se litigants. However, this entire article is rife with misrepresentations. You give a false definition of litigation privilege. You call normal parts of litigation lawyer’s tricks, like requests to admit (which are in state rules of civil procedure, and pro se litigants can send requests to admit, too). What you call lawyer’s crap in negotiations is just what you have to expect in a negotiation whether or not you’re a lawyer. Your description of stare decisis is deceptive: appellate courts don’t “give excuses” for not overturning lower court’s decisions. I mean, I get it: if you didn’t feed this David-and-Goliath complex, you wouldn’t have a marketing angle. I don’t think that pro se litigants can’t handle small cases that don’t require a lot of discovery or witnesses, and when the facts are on their side, why not? And yes, you should always have a court reporter if possible, but if you plan to make an appeal, you should also know what to say, particularly what to object to on the record, for an appeal. I don’t think that encouraging paranoid beliefs about litigation and lawyers is helpful. From this side, dealing with a pro se litigant who has a chip on their shoulder, thinks everything the lawyer does is to hurt them personally, that the fact that we don’t break attorney-client privilege simply because they want us to is shady business, that upholding our duty to represent our clients is a personal attack and such makes me think that you don’t know what you want. Do you want to go to court acting as your own lawyer, thus being treated like a lawyer and held to the same standards and dealing with the same things new lawyers deal with (even if you screw up. Ask lawyers about their first court appearances), or do you want to not be treated as a lawyer and have the rules bent just for you?
An independent and honorable judiciary is indispensable to justice in our society. A judge should maintain and enforce high standards of conduct and should personally observe those standards, so that the integrity and independence of the judiciary may be preserved. The provisions of this Code should be construed and applied to further that objective.

Under this Canon, harassment encompasses a range of conduct having no legitimate role in the workplace, including harassment that constitutes discrimination on impermissible grounds and other abusive, oppressive, or inappropriate conduct directed at judicial employees or others. Canon 4H. A judge is not required by this Code to disclose income, debts, or investments, except as provided in this Canon. The Ethics Reform Act of 1989 and implementing regulations promulgated by the Judicial Conference impose additional restrictions on judges’ receipt of compensation. That Act and those regulations should be consulted before a judge enters into any arrangement involving the receipt of compensation. The restrictions so imposed include but are not limited to: (1) a prohibition against receiving “honoraria” (defined as anything of value received for a speech, appearance, or article), (2) a prohibition against receiving compensation for service as a director, trustee, or officer of a profit or nonprofit organization, (3) a requirement that compensated teaching activities receive prior approval, and (4) a limitation on the receipt of “outside earned income.”
All of these challenges are made worse by the disparity in education between lawyers and many low-income individuals, who generally read at lower reading levels and are more comfortable with oral communication, in particular by relating stories. The American justice system depends on written rules and on written orders and decisions, written at a reading level much higher than that of the average low-income litigant. Without a lawyer (or other kind of legal problem-solver) to explain the rules, navigate the legal process, and translate orders and decisions into accessible terms, a low-income litigant is likely to be lost in the system and to lose his case.11
The inconsistent character embodies a contradiction that isn’t just a jumble but a tension that can resolve into something else. The confidence-man is trust and mistrust at once, a number of different people in one, an impossible ability to transform—and also the exact symbol of an emerging market society, the no-man and everyman you need to both trust and mistrust in order to exist under capitalism. But, in another intrusion, Melville asks:

He is able to do this because he embodies a particular contradiction regarding the need for trust in a market society. At both ends of the novel, in the confidence-man’s first and last guises, he meets a barber who has a sign saying NO TRUST—that is, pay up now, not tomorrow. This message is what the confidence-man argues against. One must always trust, extend it to all the world, he says. As a deaf-mute in the first chapter, he holds up a series of Corinthians-derived morals on charity—“Charity thinketh no evil” and so on—which strike the watching crowd as bizarre, while the barber’s sign elicits no comment. It’s clear why a barber who cut hair on credit would be risking a close shave. In his final costume, that of a garishly dressed and pompous universalist “Cosmopolitan,” he strikes up an argument with the barber. “Better cold lather, barber, than a cold heart. Why that cold sign?” One must trust mankind, he says.
