Canon 2B. Testimony as a character witness injects the prestige of the judicial office into the proceeding in which the judge testifies and may be perceived as an official testimonial. A judge should discourage a party from requiring the judge to testify as a character witness except in unusual circumstances when the demands of justice require. This Canon does not create a privilege against testifying in response to an official summons.

He convinces the barber to sign a contract agreeing to remove the offending sign and promising to have confidence in people; the confidence-man in turn agrees “to make good to the last any loss that may come from his trusting mankind, in the way of his vocation, for the residue of the present trip.” And then, deal done, he walks out, asking the barber to have confidence that he’ll pay him back for the shave.
The cost of providing attorneys for everyone who needs but cannot afford one would be huge. Providing just one hour of legal services to each person unable to afford it would cost an estimated $20–$25 billion.12 Courts cannot possibly cover this cost: cutbacks in court budgets by state legislatures mean that many courts cannot even cover their basic operating expenses.13 Few courts have money in their budgets to provide lawyers for the indigent. With $100 million for civil lawyers, New York State recently had more money for this purpose than any other state. Though the funding was far from enough to close the justice gap, the state saw a significant decline in the number of unrepresented litigants in the courts.14
All of these challenges are made worse by the disparity in education between lawyers and many low-income individuals, who generally read at lower reading levels and are more comfortable with oral communication, in particular by relating stories. The American justice system depends on written rules and on written orders and decisions, written at a reading level much higher than that of the average low-income litigant. Without a lawyer (or other kind of legal problem-solver) to explain the rules, navigate the legal process, and translate orders and decisions into accessible terms, a low-income litigant is likely to be lost in the system and to lose his case.11
We tested two predictions in Study 2: (1) whether self-affirmation increased feelings of self-compassion but not compassionate feelings toward others, and (2) whether trait self-compassion moderates the self-affirmation self-compassion effect, such that self-affirmation would be more likely to increase self-compassionate feelings among participants who had pre-existing low levels of trait self-compassion. To test these predictions, we conducted a multiple regression analysis that modeled the self-affirmation × video condition interaction, and the 3-way trait self-compassion × self-affirmation × video condition interaction. Specifically, this multiple regression analysis included the trait self-compassion continuous predictor variable, self-affirmation condition (self-affirmation = 1 or control = 0), and video condition (self = 1 or other video = 0) as predictor variables, along with their two-way interactions, and one 3-way interaction term. Table Table11 provides the results of this multiple regression analysis for compassionate feelings to the storytelling video, and Figure Figure33 visually depicts the results. Notably, this regression analysis revealed a significant main effect of video condition, such that those who watched their own video had lower feelings of compassion than those who watched the confederate’s video [β = -2.31, t(69) = -3.96, p < 0.005]. Moreover, we observed a significant trait self-compassion × video condition interaction, showing that participants lower in trait self-compassion rated their own video less favorably relative to participants higher in trait self-compassion (whereas trait self-compassion did not impact ratings of a peer’s video). This result conceptually replicates previous research showing that trait self-compassion moderates behavioral self-compassion to a storytelling video (Leary et al., 2007).

This surprisingly easy hack is one that can be done anytime, anywhere--and is rarely done enough. People underestimate the power of an erect spine or a rigid stance. Carrying yourself like you are proud to be who you are indirectly gives your brain feedback that you are indeed a lovely human, so that you subsequently positive feelings about yourself. Who knew the body could be such a powerful tool?
The “Legal Services Lawyers” metric includes attorneys from ALAS (in Clayton, Fulton, Cobb, DeKalb, and Gwinnett counties) and GLSP (outside the five-county metro Atlanta area served by ALAS). For the ALAS counties, the number of Legal Services Lawyers serving a given county reflects both attorneys assigned to that county and a portion of the 22.5 ALAS attorneys not assigned to a particular county; for example, Cobb County has 6 ALAS lawyers, but its total includes 1/5 of the program-wide attorneys for an additional 4.5 attorneys. By contrast, GLSP attorneys are assigned to a particular region of the state and serve several counties (e.g. attorneys from the Albany-Valdosta office service 29 counties). Thus, outside the five-county metro area, the Legal Services Lawyers total for a particular county includes GLSP lawyers who also serve other counties. GLSP totals for a given county do not include 7 statewide attorneys or the 2 attorneys serving farmworkers throughout the state.

I did in fact include the notice advising the defendant’s atty of the consequences of the failure to answer the request, as stated in the ORCP 45 Rule. The 30 days allotted by 45 B have elapsed and I have received no response at all, either admitting, denying or objecting to the request. I’m preparing the Motion To Determine Sufficiency, and I will follow your counsel by including a copy of the Request For Admissions, even though I filed a copy with the Court, along with proof of service, on the day I served the request to the defendant’s lawyer. If the Judge grants the motion, issues an Order… well, my case is halfway won. And, I won’t have to drag a handfull of witnesses into court, against their will, to testify. Many times I’ve felt overwhelmed by this, ready to fold my hand even though I know the defendant’s lawyer is bluffing, trying to intimidate me into giving up. Thank you very much for your knowledge, your advice, and your encouragement. I’m thinking I may very well prevail afterall.
Study 2 provides a first indication that self-affirmation increases feelings of self-compassion using an established storytelling task-based measure. This result was specific to self-compassion; self-affirmation did not affect other-directed feelings of compassion toward a peer video. Moreover, the effect of self-affirmation on feelings of self-compassion was moderated by trait self-compassion, such that self-affirmation boosted feelings of self-compassion toward the storytelling video in those who were low in trait self-compassion. These findings help clarify the Study 1 findings where it was unclear whether the compassionate feelings encouraging helping behavior were directed at the self or directed out toward others. Here we find evidence that self-affirmation fosters compassionate feelings for the self but not toward a peer, which is consistent with the self-compassion account. However, the use of a single confederate video may not have been optimally matched to real participants’ self videos, perhaps differing on unmeasured variables despite our best efforts to film this peer video under matched conditions (the female research assistant in the video had no chance to practice or provide multiple takes, and was similarly embarrassed during the task as the study participants).
There are, however, a number of limitations that courts impose upon pro se litigation. In Minnesota, for example, organizations such as corporations or other businesses cannot represent themselves, although Conciliation Court allows pro se representation with proper written authorization. Corporate entities are considered in the eyes of the law as a separate individual and generally need to be represented by legal counsel, rather than an individual or even the proprietor of the business. However, more obligations and obstacles on courts and litigants in connection with pro se litigation.
A fellow advocate member of DAC, our advocacy group, filed her Pro Se in Federal District Court, after waiting and waiting for DOJ to respond. She lives on a low fixed income, and was able to waive the filing fee. Within a week, she received her notification of receipt that her case is now pending in federal court. At the same time she received notification that the inaccessible business was being served the complaint by a federal marshal. Shortly after that, she received a letter from the attorney for the inaccessible business stating that they wanted to settle out of court. Of course!! We settled for full compliance with the ADA.
It was very nice of Kenn to share all that esoteric knowledge regarding the litigation process. I think most lawyers would only be interested in non disclosure of their dirty tricks, so many thanks to Kenn. I have not made the decision of going pro se, but even if I don't, the book is still worth to read to attain some understanding of what is going on behind the scenes in one's lawsuit.

University of Illinois Law School's Professor Robert Lawless, a national expert in personal credit and bankruptcy, showed that, the rate of non-attorney filings in bankruptcy courts by debtors was 13.8% for chapter 13 cases, and 10.1% for chapter 7 cases. The rate was as high as 30% to 45% for major urban areas, such as California and New York city. US Bankruptcy Court of Arizona reported 23.14% cases filed pro se in October 2011, up from 20.61% a year before.
