A manipulation check confirmed that participants in the experimental condition identified with their chosen value and found meaning through the writing exercise as compared to the control group. Affirmed participants strongly agreed that the value they wrote about was important to their self-identity (M = 5.67; SD = 0.39), while control participants disagreed (M = 3.40, SD = 0.93) [F(1,73) = 196.32, p < 0.0005], indicating that affirmed participants found personal value in their topic.

So, you have to decide what your goal is: (1) To post your complaint on the web in all its vitriolic splendor and go down in a blaze of glory or (2) to win your case. If its the former, go for it! If its the latter, get some help to draft a complaint in law talk, keep it simple, and go for the bucks you need to survive. You can do that, and still keep the street war going in a forum other than the courtroom. That's the win-win approach.
Can I afford a private child custody attorney? Each parent is aware of his/her own, unique financial position and resources. Some parents borrow money for an attorney, while others may possess significant savings. Divorced parents are often fortunate enough to have legal expenses covered by a former spouse, written directly into a divorce decree. If parents are of modest means, pro se representation might be an appropriate alternative to hiring a private child custody lawyer, but cost should not be the only consideration.
Proof that the plaintiff has the right to sue you.  In the case of a debt buyer, the debt buyer must prove that it owns your debt by showing the court the contract of sale.  This contract is called an “assignment.”  The assignment must mention your debt specifically.  If your debt has been bought and sold multiple times, the debt buyer must present a chain of assignments that goes all the way back to your original creditor.
Even though it's great to share our goals and aspirations with others--whether they are personal or career-oriented--opening ourselves up to that sense of vulnerability to others subconsciously creates anxiety. Show your best face to the world--whatever that means for you. When you feel comfortable in your own skin, everyone knows. If you like to go out in a dress and heels, or a well-cut suit, go for it. If you prefer to stay comfy in a pair of sweats and flip-flops, there's no shame in that either. Dress how you want. The You'll undoubtedly exude confident, assuring energy.
Researching a business’s financial situation is a bit trickier than a person, but there are still things you can do. Drive past the business. If it is a retail establishment, restaurant, or store, are there people going in and out? Does it appear to be relatively successful? Does it own any equipment, vehicles, or merchandise? Does it have a legitimate website and social media presence? Read any reviews or articles you find relating to that business.

My question is: Can I serve my soon to be ex-wife a Discovery request even though I’m pro se and representing myself? I was served with a request from her attorney after our hearing for temporary alimony and child support and I want to counter act with a request as well. Her attorney is taking full advantage of my pro se circumstances and incompetent knowledge of divorce law as she should. I don’t want this to be an easy win for her when I have evidence that can work in my favor. I just need to find the best way to get it in front of the judge without being bullied in the court room. I don’t know my rights as a pro se litigant and I need as much advice as possible. I picked up her financial affidavit from the clerks office and she’s leaving out a lot of income that needs to be uncovered in my case. The issue is being overwhelmed by all of her attorney deadlines and demands which sidetracks my course of action to respond in my defense appropriately.

All of these challenges are made worse by the disparity in education between lawyers and many low-income individuals, who generally read at lower reading levels and are more comfortable with oral communication, in particular by relating stories. The American justice system depends on written rules and on written orders and decisions, written at a reading level much higher than that of the average low-income litigant. Without a lawyer (or other kind of legal problem-solver) to explain the rules, navigate the legal process, and translate orders and decisions into accessible terms, a low-income litigant is likely to be lost in the system and to lose his case.11
The plaintiff — the creditor or debt buyer — ALWAYS has the burden of proof in a debt collection case.  This means that the plaintiff has to come up with evidence to prove to the court that (1) the plaintiff has the right to sue you; (2) the debt is yours; and (3) you owe the exact amount of money that the plaintiff claims you owe.  You do not have to prove that you do not owe the money.  Rather, the plaintiff has to prove that you DO owe the money.

We tested two predictions in Study 2: (1) whether self-affirmation increased feelings of self-compassion but not compassionate feelings toward others, and (2) whether trait self-compassion moderates the self-affirmation self-compassion effect, such that self-affirmation would be more likely to increase self-compassionate feelings among participants who had pre-existing low levels of trait self-compassion. To test these predictions, we conducted a multiple regression analysis that modeled the self-affirmation × video condition interaction, and the 3-way trait self-compassion × self-affirmation × video condition interaction. Specifically, this multiple regression analysis included the trait self-compassion continuous predictor variable, self-affirmation condition (self-affirmation = 1 or control = 0), and video condition (self = 1 or other video = 0) as predictor variables, along with their two-way interactions, and one 3-way interaction term. Table ​Table11 provides the results of this multiple regression analysis for compassionate feelings to the storytelling video, and Figure ​Figure33 visually depicts the results. Notably, this regression analysis revealed a significant main effect of video condition, such that those who watched their own video had lower feelings of compassion than those who watched the confederate’s video [β = -2.31, t(69) = -3.96, p < 0.005]. Moreover, we observed a significant trait self-compassion × video condition interaction, showing that participants lower in trait self-compassion rated their own video less favorably relative to participants higher in trait self-compassion (whereas trait self-compassion did not impact ratings of a peer’s video). This result conceptually replicates previous research showing that trait self-compassion moderates behavioral self-compassion to a storytelling video (Leary et al., 2007).
One last word on this topic: Just because a person or business is broke does not necessarily mean pursuing a judgment is pointless. The future is uncertain. A person can eventually inherit money, start a successful business, or sell off property. Depending on the state, judgments may be valid for 10-20 years, and can often be renewed. The big question is: How long are you willing to wait to recover your money… if ever?
A pro se litigant is an individual who is representing himself in a civil court action. While the law allows nearly anyone to be a pro se litigant, and to appear in court on their own behalf, there are some limitations. We will start with pro se. That's a Latin term meaning on one's own behalf and in a court setting it refers to persons who present their own cases without lawyers or other representatives. Now some people choose to act pro se because they have legal experience or they're otherwise very confident about their ability to convey their claim or their defence without any assistance. Other people may simply wish to avoid paying attorney's fees and the often exorbitant expenses associated with hiring a lawyer.
Our research makes clear that the large number of unrepresented citizens overwhelming the nation’s courts has negative consequences not only for them but also for the effectiveness and efficiency of courts striving to serve these and other segments of the community who need their disputes resolved. More staff time is required to assist unrepresented parties. In the absence of a fair presentation of relevant facts, court procedures are slowed, backlogs of other court cases occur, and judges confront the challenge of maintaining their impartiality while preventing injustice.20

Self-Representation.—The Court has held that the Sixth Amendment, in addition to guaranteeing the right to retained or appointed counsel, also guarantees a defendant the right to represent himself. this a right the defendant must adopt knowingly and intelligently; under some circumstances the trial judge may deny the authority to exercise it, as when the defendant simply lacks the competence to make a knowing or intelligent waiver of counsel or when his self-representation is so disruptive of orderly procedures that the judge may curtail it. the essential elements of self-representation were spelled out in McKaskle v. Wiggins…
Every Supreme Court Justice is in charge of a judicial circuit in the country. The justices and the Judicial Conference of the United States should make each federal judge understand that they are expected to treat pro se litigants with respect and without disdain. They should make clear that judicial councils will take complaints seriously if judges behave in a prejudicial manner toward litigants who represent themselves.
The State Bar of Georgia provided the number of lawyers by county in 2016. By combining this data with information from the Self Represented Litigation Network, available census data from the 2014 American Community Survey, 2015 statistics from the Federal Communications Commission, data from the Center for Neighborhood Technology, and 2016 information from the Georgia Legal Services Program (GLSP) and the Atlanta Legal Aid Society (ALAS), the map provides insight into attorney representation and other factors that impact access to justice throughout the state.

You need the ability to think more in terms like, "That is A view" versus "There is my view and the wrong view."  "That is A defense" versus "They don't have a defense."  Being impatient or intolerant with another's view, defense or assertion appears as immaturity in the courtroom.  Opposing side is supposed to have a view, defense or assertion.  Many times you will deal with outrageous arguments using deceit and/or lies that would never be used as arguments outside the courtroom.

If you’re a Gangster, you’re almost there. You already have more knowledge, experience, skills and confidence than the lesser types. Just realize that you can’t always win with brute force. Add persuasion to your skill set, and fill gaps in your knowledge of protocol and procedure. That way, you won’t need to rely on brute force. That’s how you become a Conqueror.


Pro se means that you are representing yourself in court, without a lawyer. Another term is self-represented litigant. If you represent yourself in a family matter, the court will ask you to attend a Pro Se Education Program. The program helps you understand court procedures and the forms you need to file with the court. Classes are free and open to the public.
Our present findings suggest that self-affirmation may increase feelings of self-compassion, and that self-compassion may be a promising new mechanism for a potentially broad range of self-affirmation effects. More research is needed, but the present research provides an initial suggestion that affirming an important personal value increases feelings of self-compassion for mobilizing a pro-social self.
Experimenters remained blind to participants’ affirmation condition during the experimental session, following procedures as in Study 1. Following procedures from recent self-compassion research (Leary et al., 2007, Study 4), participants arrived at the lab one-at-a-time for a study they believed explored the influence of adults’ moods on story telling. After providing written informed consent, participants completed individual difference baseline measures, including trait self-compassion (Neff, 2003b; Raes et al., 2011). Specifically, participants completed the 12-item Self-Compassion Scale – Short Form, which measures the frequency of self-compassionate feelings on a day to day basis (anchored 1 = almost never to 5 = almost always). Items were averaged to form a composite measure of trait self-compassion, with negative items reverse-scored (α = 0.86; Neff, 2003b; Raes et al., 2011). Trait self-compassion was embedded among two other exploratory baseline questionnaires: the NEO Five-Factor Inventory (NEO-FFI) Extraversion subscale (Costa and McCrae, 1992), and the Dispositional Positive Emotions Scale (DPES) Compassion subscale (Shiota et al., 2006). Then, following existing procedures for testing compassionate feelings (Leary et al., 2007, Study 4), participants were videotaped while telling an extemporaneous children’s story beginning with, “Once upon a time, there was a little bear…” for 90 s. Participants, who believed we were collecting pilot data for an unrelated study, next completed a 3-min self-affirmation or control writing exercise as described in Study 1. Additionally, participants completed a 4-item manipulation check (α = 0.97) assessing whether the writing exercise was important to their self-identity. Specifically, participants rated the personal importance of the value they wrote about on a 6-point Likert scale (strongly disagree – strongly agree; i.e., “This value is an important part of who I am;” “In general, I try to live up to this value”).

Gary Zeidwig doesn’t think so, at least not all the time. Zeidwig, an award-winning lawyer, reveals that there are some cases where an individual can move forward pro se, (for oneself) that is, advocating without an attorney and defending or fighting for their rights on their own behalf, and that it’s not only acceptable but relatively safe to do so.

Although Canon 2C relates only to membership in organizations that invidiously discriminate on the basis of race, sex, religion or national origin, a judge’s membership in an organization that engages in any invidiously discriminatory membership practices prohibited by applicable law violates Canons 2 and 2A and gives the appearance of impropriety. In addition, it would be a violation of Canons 2 and 2A for a judge to arrange a meeting at a club that the judge knows practices invidious discrimination on the basis of race, sex, religion, or national origin in its membership or other policies, or for the judge to use such a club regularly. While the Due Process Clause does not require the provision of counsel in a civil contempt case for failure to pay child support when the opposing parent is not represented by counsel, the court should provide "alternative procedural safeguards," such as "adequate notice of the importance of ability to pay, fair opportunity to present, and to dispute, relevant information, and court findings."


Later, when time comes to my response, like a bipolar, I keep jumping from Magician to Conqueror and then crave badly to be act like an aggressor. I end up changing my response over and over and over again, until I get the Aggressor out of my system. Then I do my best to mix Magician—common sense—approach to reach a Conqueror-level response document.
The confidence-man occupies the point of slippage between trust and distrust. If you distrust me, he says, you must distrust all men, and what a wretched way to live that would be. If you trust all men, he says, and I am a man, you must trust me. As he argues, he relies on an image of humanity in the abstract that is to be trusted, and from that he derives his own trustworthiness. This is the same move we have to make to have trust under capitalism. In a pre-modern community, trust is always specific, given to particular individuals based on a complex network of social ties. Under capitalism, trust is generalized, given to people and things on the basis of their being instances of abstract conditions. A dollar bill, a brand of product, an anonymous stranger are all trustworthy because of their resemblance to other things, not their specific qualities.

After conducting an empirical study of pro se felony defendants, I conclude that these defendants are not necessarily either ill-served by the decision to represent themselves or mentally ill. ... In state court, pro se defendants charged with felonies fared as well as, and arguably significantly better than, their represented counterparts ... of the 234 pro se defendants for whom an outcome was provided, just under 50 percent of them were convicted on any charge. ... for represented state court defendants, by contrast, a total of 75 percent were convicted of some charge. ... Only 26 percent of the pro se defendants ended up with felony convictions, while 63 percent of their represented counterparts were convicted of felonies ... in federal court ... the acquittal rate for pro se defendants is virtually identical to the acquittal rate for represented defendants.[35]
