Laws and organizations charged with regulating judicial conduct may also affect pro se litigants. For example, the Judicial Council of California officially advocates treating self-represented litigants fairly.[9] The California rules allow for accommodating mistakes by a pro se litigant that would otherwise result in a dismissal, if the case is otherwise merited.[10] In addition the Federal Rules of Civil Procedure rule 56 on summary judgments notes that pro se litigants may need additional advice with regard to necessity of responding a summary judgment motion.[11]

Make sure you follow those instructions! At that point, you will be given so many days to serve the defendant with the court summons. In some districts, the plaintiff has the choice of either delivering the summons himself, a friend deliver it, or having a federal Marshal deliver it. It is most effective to have either a federal Marshal deliver the summons, or a really big guy in a suit. Whoever delivers the summons must make a note of who the summons is delivered to, what the date is, and what time it was delivered. Record this information on the appropriate form that is sent to you with the summons, and take it back to the district court.

Let’s say you go to court and a court reporter is not present. You argue very strong points against an attorney with weak ones. Despite both the law and facts on your side, you lose. Think an appellate court will understand what went wrong and overturn the ruling? Probably not. Appellate courts will find many excuses not to overturn a lower court ruling. Without a court reporter’s transcript, an appellate court will say that the lower court was in the best position to evaluate the arguments made. Then, they’ll let the lower court decision stand. A court reporter, on the other hand, creates an official record of proceedings that can be sent to the appellate court. In the lower court, the simple presence of a court reporter greatly curtails judicial bias and bad behavior from lawyers. With that, you have a better chance of getting a fair hearing. (1) A judge may hold and manage investments, including real estate, and engage in other remunerative activity, but should refrain from financial and business dealings that exploit the judicial position or involve the judge in frequent transactions or continuing business relationships with lawyers or other persons likely to come before the court on which the judge serves.

I’m trying to accept the Judges recommendation fir division of property in a divorce case and avoid trial but my lawyer is trying to go to trial to Tim up the fees … I know I can dismiss lawyer but how do I tell the judge that I want to accept her recommendation for division of property ? A judge who is retired under 28 U.S.C. § 371(b) or § 372(a) (applicable to Article III judges), or who is subject to recall under § 178(d) (applicable to judges on the Court of Federal Claims), or who is recalled to judicial service, should comply with all the provisions of this Code except Canon 4F, but the judge should refrain from judicial service during the period of extrajudicial appointment not sanctioned by Canon 4F. All other retired judges who are eligible for recall to judicial service (except those in U.S. territories and possessions) should comply with the provisions of this Code governing part-time judges. However, bankruptcy judges and magistrate judges who are eligible for recall but who have notified the Administrative Office of the United States Courts that they will not consent to recall are not obligated to comply with the provisions of this Code governing part-time judges. Such notification may be made at any time after retirement, and is irrevocable. A senior judge in the territories and possessions must comply with this Code as prescribed by 28 U.S.C. § 373(c)(5) and (d).
A fellow advocate member of DAC, our advocacy group, filed her Pro Se in Federal District Court, after waiting and waiting for DOJ to respond. She lives on a low fixed income, and was able to waive the filing fee. Within a week, she received her notification of receipt that her case is now pending in federal court. At the same time she received notification that the inaccessible business was being served the complaint by a federal marshal. Pro se representation refers to a situation in which a person decides not to be represented by an attorney in a civil or criminal court case. The right of an individual to choose pro se representation dates back to pre-Constitutional times in the U.S. Although individuals have the right to represent themselves during legal actions, there are certain requirements. For example, the individual must have the mental capacity necessary to represent himself, which may be determined by the court, if questioned. Additionally, an individual choosing pro se representation must observe all of the rules of the legal action and the courtroom, just as an attorney would be expected to do.

When going through divorce, it is not required for either party to be represented by an attorney, and in fact, many choose to save money by representing themselves in a pro se divorce. The necessary forms for divorce are available at the local family court, and many jurisdictions offer family law family law facilitators to provide information on the process of divorce to pro se litigants. In a divorce in which both parties can agree on the issues of division of marital property, and child custody and support, a pro se divorce may be the best choice for all. On the other hand, when there is serious conflict over these issues, the divorce may become quite complicated, and hiring an attorney may be the better choice.

Canon 3A(4). The restriction on ex parte communications concerning a proceeding includes communications from lawyers, law teachers, and others who are not participants in the proceeding. A judge may consult with other judges or with court personnel whose function is to aid the judge in carrying out adjudicative responsibilities. A judge should make reasonable efforts to ensure that law clerks and other court personnel comply with this provision.
Researching a business’s financial situation is a bit trickier than a person, but there are still things you can do. Drive past the business. If it is a retail establishment, restaurant, or store, are there people going in and out? Does it appear to be relatively successful? Does it own any equipment, vehicles, or merchandise? Does it have a legitimate website and social media presence? Read any reviews or articles you find relating to that business.
Canon 4F. The appropriateness of accepting extrajudicial assignments must be assessed in light of the demands on judicial resources and the need to protect the courts from involvement in matters that may prove to be controversial. Judges should not accept governmental appointments that could interfere with the effectiveness and independence of the judiciary, interfere with the performance of the judge’s judicial responsibilities, or tend to undermine public confidence in the judiciary.
Reflecting on an important personal value in a self-affirmation exercise has been shown to have a broad range of beneficial effects across over 225 published studies (for reviews, see Sherman and Cohen, 2006; Cohen and Sherman, 2014). For example, a brief self-affirmation of an important personal value, such as writing about why you value friends and family, has been shown to buffer many different threats to the self, such as reducing rumination in response to failure feedback (Koole et al., 1999), lowering stress reactivity to social evaluation (Creswell et al., 2005, 2013), and in mitigating the effects of stereotype threat on academic performance in classroom settings (Cohen et al., 2006; Miyake et al., 2010). Despite this large body of work, the mechanisms of self-affirmation are not well specified, and currently two theoretical perspectives have been offered to explain how self-affirmation exerts its effects. A longstanding theoretical perspective posits that self-affirmation boosts one’s self-image for coping with self-threats (Sherman and Cohen, 2006). Although some studies provide support for this self-resources account (e.g., increasing self-esteem and self-regulatory strength; Schmeichel and Vohs, 2009; Sherman and Hartson, 2011), empirical support for this mechanistic explanation has been limited (Sherman and Cohen, 2006; Crocker et al., 2008). In contrast, a more recent theoretical perspective offers that self-affirmation enables one to transcend self-image concerns by increasing other-directed feelings (Crocker et al., 2008). In one influential study, Crocker et al. (2008) showed that affirmed participants reported greater feelings of love and connection, and that these feelings statistically explained how self-affirmation reduced defensiveness to a threatening health message.
Capitalism has a peculiar, contradictory relationship to trust. According to one way of thinking about it, if everyone’s looking out for their own interest, they’ll trust people as far as they can throw them, sleep with one eye open, because everyone’s out to screw you over. It’s not like there are communal bonds or family ties for people to rely on in most commercial interactions. But in everyday life, people are remarkably trusting. People go out and buy things from strangers, make and take loans, and don’t read the fine print. Capitalism depends on baseline trust to keep running. It may depend a whole lot more on a legal system and men with guns—but it needs some level of confidence to stop people from being misers hiding money in mattresses, or even for those misers to think that money is worth hiding in a mattress in the first place.

It was predicted that self-affirmation increases pro-social behavior. This hypothesis was tested in two ways. First, it was predicted that affirmed participants would indicate a desire to give more of their income to charities on the spending survey. A significant positive relationship between family income and charitable giving was observed in this sample (r = 0.31, p = 0.02), so family income was used as a covariate in this analysis. A one-way (condition: self-affirmation, control) ANCOVA yielded a significant main effect on percentage of income allocated to charitable donations [F(1,50) = 5.90, p = 0.02, η2 = 0.11]. Specifically, affirmation participants indicated a greater desire for charitable giving (M = 6.58%, SD = 3.66) compared to control participants (M = 4.24%, SD = 3.41). Without controlling for family income, the effect of self-affirmation on charitable giving did not reach statistical significance [F(1,50) = 2.21, p = 0.14, η2 = 0.04]. Second, it was predicted that self-affirmed participants would exhibit greater helping behavior to the shelf-collapse incident. Indeed, a one-way ANOVA confirmed that self-affirmation participants helped more (M = 3.92, SD = 3.02) than control participants in response to the shelf-collapse incident (M = 2.33, SD = 2.2) [F(1,46) = 4.32, p = 0.04, η2 = 0.09].
Canon 3C(1)(c). In a criminal proceeding, a victim entitled to restitution is not, within the meaning of this Canon, a party to the proceeding or the subject matter in controversy. A judge who has a financial interest in the victim of a crime is not required by Canon 3C(1)(c) to disqualify from the criminal proceeding, but the judge must do so if the judge’s impartiality might reasonably be questioned under Canon 3C(1) or if the judge has an interest that could be substantially affected by the outcome of the proceeding under Canon 3C(1)(d)(iii).
