Canon 4B. The changing nature of some organizations and their exposure to litigation make it necessary for a judge regularly to reexamine the activities of each organization with which the judge is affiliated to determine if the judge’s continued association is appropriate. Let’s say you go to court and a court reporter is not present. You argue very strong points against an attorney with weak ones. Despite both the law and facts on your side, you lose. Think an appellate court will understand what went wrong and overturn the ruling? Probably not. Appellate courts will find many excuses not to overturn a lower court ruling. Without a court reporter’s transcript, an appellate court will say that the lower court was in the best position to evaluate the arguments made. Then, they’ll let the lower court decision stand. A court reporter, on the other hand, creates an official record of proceedings that can be sent to the appellate court. In the lower court, the simple presence of a court reporter greatly curtails judicial bias and bad behavior from lawyers. With that, you have a better chance of getting a fair hearing. 2. Most district courts require you to have an original copy, a copy for each defendant, and an extra. Ask your clerk if they require more copies, and don't forget to keep a copy for yourself. 3. When you go to the district court's office, follow the clerk's instruction. They tend to be very helpful, and will usually lead you through the rest of the process. Lawyers are necessary outside of traditional litigation, too. Many disputes today are resolved through settlements negotiated outside of court. I've spent a lot of time sending accessibility complaints to the DOJ for the "mediation process", which is supposed to be a faster way to get better compliance. No response. I waited and got no response. I'm still waiting for, at the very least, a letter confirming that they received the things, let alone tell me what action, if any, they would be taking. Nothing.

Congress also has a role. In extreme cases it has the power to remove judges, of course. But short of that, it can at least underscore the seriousness of the rights it established for litigants in the Judiciary Act. Whether through binding or nonbinding language on the topic, Congress can make clear that complaints about violations of the rights of pro se litigants must be taken very seriously by judicial councils.

Pro se litigants have been steadily increasing over the past decade. The right of an individual to represent his/her own cause has long been legally permissible, dating back to the birth of our nation and signed into law by our first president, George Washington. (Laws do exist, however, barring certain types of individual representation in order to protect the parties involved.)
Also, I don’t know what this obligation is to give access to justice that is apparently on the shoulders of individual lawyers. I only know of the 6th Amendment right to an attorney for defendants in a criminal trial, in which case any lawyer could be appointed to represent a defendant; I know of no other obligation to make legal services available to everyone on demand. But you can’t seriously tell me that you don’t pit pro se litigants against lawyers and publish the articles you do. I know some lawyers who are pretty burnt out dealing with pro se nonsense, and I know some who are more generous to those who play lawyer for themselves, but when your opposing counsel is a pro se litigant who can’t distinguish you from your client, or doesn’t understand why you’re representing your client vigorously and then goes on the defense, you wish you could just tell them what is obvious to you: it’s not about them. For example, I might be hesitant to encourage Tanya here to represent herself since she doesn’t seem to understand the difference between pro bono and contingency and statutes and case law, and that she hasn’t actually found any case law yet before deciding to pursue her lawsuit on her own and presenting what may be a matter of first impression, but that’s not my business…
I’ve filed and served a request for admissions which the Defendant”s attorney failed to answer within the 30 day period allotted by rule here in Oregon. The rules also state that a failure to answer the request will result in admission of the answers requested. From what I can glean from the rules, I now need to file a “Motion To Determine Sufficiency”. If I fail to file such a motion, can I simply ask the court to declare, at the outset of trial, that the defendant, by failing to answer the admissions request, has in fact admitted certain facts which I no longer must prove at trial?
Yet the world of the ship is also a land of gab. Conversations and wheeling and dealing break out constantly. There’s a kind of aspirational sociability to life among strangers. It’s always possible that you’re walking into a den of thieves, but it’s more likely that most people are basically decent. If we took a position of total mistrust, we’d all wind up staying in our rooms the whole time to avoid getting fleeced or stabbed. There has to be some baseline level of confidence for exchange to occur, or even for people to just get along and pick up a story or two. Melville’s character hits people where they’re most vulnerable: by trying to act decently, by trying to follow humane norms of behavior, they end up suckers. A minister, for instance, denounces the embittered fellow who says a cripple is an imposter in blackface and gives the beggar a coin (rather than throwing it in his mouth, the cruel sport of the other guests). For his trouble he is rewarded with a visit from a man in gray, who praises him and says, “Since you are of this truly charitable nature, you will not turn away an appeal in behalf of the Seminole Widow and Orphan Asylum?” But the cynics don’t fare any better: a stingy miser buys some herbal concoction in the hope that it will soothe his pain, and a misanthrope who’d rather have machines than boys work his farm agrees to take on a lad from another smooth operator’s Philosophical Intelligence Office, a kind of antebellum temp agency. The confidence-man worms his way into the pockets of trusting and suspicious passengers alike.
Even though it's great to share our goals and aspirations with others--whether they are personal or career-oriented--opening ourselves up to that sense of vulnerability to others subconsciously creates anxiety. Although we may not even realize it, sharing the things you would most like to achieve involuntarily sets expectations for ourselves in the eyes of others--expectations that can often sap your confidence if unmet.
Although it's a little cheesy, having an alter ego of sorts is a very helpful way to boost self-confidence. If we pretend like we're someone else--strong, willful, self-confident--we never have to subject ourselves to the fear of our personal worth not being enough for others. We should not necessarily lie about who we are, or invent false facts, but instead find another mode of existence in which we may tap into to be comfortable in our own skin.
Very often, we forget to value ourselves as people. We place great emphasis on the things we've accomplished, the work we've put out, and the actions we've done. At the end of the day, however, what really matters is who we are--and how those we love see us. Surround yourself with people who care deeply about you outside of your material output, and watch your self-love skyrocket.
Do I have a basic understanding of how court procedures work? Custody hearings, and court procedures in general, can be quite confusing for first-timers. Parents considering pro se representation usually benefit from attending a couple of court hearings in advance, just to become more familiar with what to expect in court and what proper court etiquette looks like. (And remember: any questions you have about proper court procedures can always be addressed to the court clerk. So seek that person out and develop a friendly rapport with him or her.)
Although it's important to know how to self-critique and self-analyze in order to functionally improve, overwhelming your mind with self-hate and negativity can only bring you down. Reduce the negative energy swarming your thoughts and turn them into productive ones. Instead of lamenting the things you have to change, focus on how you can use their improvements to make yourself a better person.

Codes of judicial ethics require judges to be impartial and neutral.16 But neutrality is not the same as passivity. Judges are permitted “to make reasonable accommodations to ensure pro se litigants the opportunity to have their matters fairly heard.”17 Yet judges worry about appearances: they are concerned that assisting an unrepresented litigant will make them seem to be taking sides, forsaking their neutrality.18 This concern has led judges to recuse themselves from cases after they have provided assistance to unrepresented litigants.19

When a judge determines that an organization to which the judge belongs engages in invidious discrimination that would preclude membership under Canon 2C or under Canons 2 and 2A, the judge is permitted, in lieu of resigning, to make immediate and continuous efforts to have the organization discontinue its invidiously discriminatory practices. If the organization fails to discontinue its invidiously discriminatory practices as promptly as possible (and in all events within two years of the judge’s first learning of the practices), the judge should resign immediately from the organization.

Other voices in the citizenry must join with the judiciary to ensure that adequate funding is available to provide lawyers to the indigent and to develop mechanisms to make lawyers affordable to moderate income individuals. Lack of action will devastate the justice system. That will leave the rule of law in ruins, shattering the foundation of American democracy. Any other course will diminish the respect and moral standing the United States has enjoyed as a leader of democratic governments.


Do I have a basic understanding of the required court documents? Mounds of documents can be very intimidating to a lot of people, legal officials included. Parents considering pro se representation should become familiar with various types of family law documents. Again, become friendly with the court clerk and ask for his or her help identifying the correct forms, where to get them, when they are due, and how they should be submitted.

This is an insane book, beautifully written, poetic and philosophical, with one of the most sudden, craziest feel bad endings I've seen since Dostoevsky's The Demons. In the last few chapters there is one murder, two suicides, and one death by shock/heartbreak.
Canon 2A. An appearance of impropriety occurs when reasonable minds, with knowledge of all the relevant circumstances disclosed by a reasonable inquiry, would conclude that the judge’s honesty, integrity, impartiality, temperament, or fitness to serve as a judge is impaired. Public confidence in the judiciary is eroded by irresponsible or improper conduct by judges, including harassment and other inappropriate workplace behavior. A judge must avoid all impropriety and appearance of impropriety. This prohibition applies to both professional and personal conduct. A judge must expect to be the subject of constant public scrutiny and accept freely and willingly restrictions that might be viewed as burdensome by the ordinary citizen. Because it is not practicable to list all prohibited acts, the prohibition is necessarily cast in general terms that extend to conduct by judges that is harmful although not specifically mentioned in the Code. Actual improprieties under this standard include violations of law, court rules, or other specific provisions of this Code.

Make sure you follow those instructions! At that point, you will be given so many days to serve the defendant with the court summons. In some districts, the plaintiff has the choice of either delivering the summons himself, a friend deliver it, or having a federal Marshal deliver it. It is most effective to have either a federal Marshal deliver the summons, or a really big guy in a suit. Whoever delivers the summons must make a note of who the summons is delivered to, what the date is, and what time it was delivered. Record this information on the appropriate form that is sent to you with the summons, and take it back to the district court.

We believe that the most important contribution this work makes is in relating the two leading theoretical perspectives on the mechanisms of self-affirmation, offering one account for how the self-resources and self-transcendence perspectives may be linked, via self-compassion. Overall, our results suggest a process through which self-affirmation may mobilize self-resources (specifically, self-compassion), which in turn allow for self-transcendence (and pro-social focus on others).


Why file a Pro Se complaint? As the chair of an advocacy group called the Disability Action Crew (DAC), I have lots of information to help others advocate for access. With every question I get asked about advocacy, it seems I often end up with more questions that go unanswered. It's like a coach trying to beat a team that makes all the rules as the game goes along. He's out there, he's trying to win, but every time he goes for the goal there's a different set of rules. Advocacy's like that‹we don't know the rule of winning access until we break them. And we look to authorities for the answers: the DOJ, the EEOC, the HRC, the DOT.
From the prison library, Gideon appealed to the United States Supreme Court, stating that, because he was denied counsel, his Sixth Amendment rights had been violated. In its 1963 ruling, the Supreme Court held that representation by counsel, even by defendants who cannot afford to hire an attorney, is a fundamental right under the U.S. Constitution. The opinion further stated that, because the Sixth Amendment does not distinguish between capital and non-capital offenses, the services of an attorney must be provided for an impoverished defendant in all criminal cases.
Canon 3C(1)(d)(ii). The fact that a lawyer in a proceeding is affiliated with a law firm with which a relative of the judge is affiliated does not of itself disqualify the judge. However, if “the judge’s impartiality might reasonably be questioned” under Canon 3C(1), or the relative is known by the judge to have an interest in the law firm that could be “substantially affected by the outcome of the proceeding” under Canon 3C(1)(d)(iii), the judge’s disqualification is required.
In response to the shortage of lawyers, despite insufficient resources, many court systems are trying to find ways to level the playing field by making legal forms and processes simpler and easier to use by people without lawyers. Simplification works for some kinds of cases, but it is not a substitute for lawyers when people have complicated substantive or procedural defenses or claims to pursue. Providing a lawyer, or a legal problem-solver, to those who cannot afford one is often the only way to equalize justice. Other forms of legal assistance are helpful and necessary, but they are inadequate to close the gap in access to justice.
Reflecting on an important personal value in a self-affirmation exercise has been shown to have a broad range of beneficial effects across over 225 published studies (for reviews, see Sherman and Cohen, 2006; Cohen and Sherman, 2014). For example, a brief self-affirmation of an important personal value, such as writing about why you value friends and family, has been shown to buffer many different threats to the self, such as reducing rumination in response to failure feedback (Koole et al., 1999), lowering stress reactivity to social evaluation (Creswell et al., 2005, 2013), and in mitigating the effects of stereotype threat on academic performance in classroom settings (Cohen et al., 2006; Miyake et al., 2010). Despite this large body of work, the mechanisms of self-affirmation are not well specified, and currently two theoretical perspectives have been offered to explain how self-affirmation exerts its effects. A longstanding theoretical perspective posits that self-affirmation boosts one’s self-image for coping with self-threats (Sherman and Cohen, 2006). Although some studies provide support for this self-resources account (e.g., increasing self-esteem and self-regulatory strength; Schmeichel and Vohs, 2009; Sherman and Hartson, 2011), empirical support for this mechanistic explanation has been limited (Sherman and Cohen, 2006; Crocker et al., 2008). In contrast, a more recent theoretical perspective offers that self-affirmation enables one to transcend self-image concerns by increasing other-directed feelings (Crocker et al., 2008). In one influential study, Crocker et al. (2008) showed that affirmed participants reported greater feelings of love and connection, and that these feelings statistically explained how self-affirmation reduced defensiveness to a threatening health message.

According to Boston Bar Association Task Force 1998 report in every court studied by the task force, litigants without lawyers are present in surprising numbers. In some counties, over 75% of the cases in Probate and Family Courts have at least one party unrepresented. In the Northeast Housing Court, over 50% of the landlords and 92% of the tenants appear without lawyers in summary process cases.[40]
