Clarence Earl Gideon, a man who could not afford to hire an attorney to represent him, appeared in a Florida court in 1961, after being accused of felony breaking and entering, requesting that the court appoint counsel to represent him. The state court denied his request, stating that Florida state law allowed the appointment of counsel only if the defendant has been accused of a capital offense. Gideon, who was forced to act pro se was convicted of the crime and sentenced to 5 years in prison.
Not surprisingly, this disparity in legal knowledge and skill on the part of pro se litigants produces a host of unique problems for the courts and the bar in general and, in particular, for trial counsel. Nevertheless, despite the many challenges they bring to the table, pro se litigants are here to stay, and their numbers are steadily growing. According to the National Center for State Courts, the number of pro se litigants in civil cases continues to rise, and there is every reason to believe this trend will continue. https://www.ncsc.org/. In fact, the number of annual non-prisoner pro se filings each year in federal courts alone tops about 25,000 and constitutes a significant section of the federal caseload. In 2011, the Federal Judicial Conference surveyed federal court clerks offices regarding pro se issues. They found that only 17 of 62 responding judges report that discovery is taken in most non prisoner pro se cases and only 13 reported that discovery is taken in most prisoner pro se cases.[16]:21 In the same survey, 37% of judges found that most pro ses had problems examining witnesses, while 30% found that pro ses had no or few problems examining witnesses.[16]:22 53% found that represented parties sometimes or frequently take advantage of pro se parties.[16]:23 Only 5% reported problems of pro ses behaving inappropriately at hearings.[16]:24 Respondents to the FJC study did not report any orders against non prisoner pro se litigation.[16]

Most family divisions of the Vermont Superior Court offer a one-hour program each month. Other divisions offer them quarterly. A lawyer who practices in the family division conducts the program. The lawyer cannot talk to you about the specifics of your case. Instead, you will receive general information about the law and the process. Deference to the judgments and rulings of courts depends on public confidence in the integrity and independence of judges. The integrity and independence of judges depend in turn on their acting without fear or favor. Although judges should be independent, they must comply with the law and should comply with this Code. Adherence to this responsibility helps to maintain public confidence in the impartiality of the judiciary. Conversely, violation of this Code diminishes public confidence in the judiciary and injures our system of government under law.
Other voices in the citizenry must join with the judiciary to ensure that adequate funding is available to provide lawyers to the indigent and to develop mechanisms to make lawyers affordable to moderate income individuals. Lack of action will devastate the justice system. That will leave the rule of law in ruins, shattering the foundation of American democracy. Any other course will diminish the respect and moral standing the United States has enjoyed as a leader of democratic governments.

Participants rated affect items “right now” before and after the affirmation exercise on a 5-point Likert scale (not at all to extremely; Watson et al., 1988). Affect items were selected based on Crocker et al. (2008; Figure ​Figure11), and allowed us to test for changes in feelings related to the construct of self-compassion (e.g., greater sympathy, less criticism; cf. Neff, 2003a) and to test single item measures of social connection previously implicated in self-affirmation effects (e.g., love; Crocker et al., 2008; see Measures). To ensure participants did not link the affirmation activity with the subsequent pro-social dependent measure and to reduce suspicion, participants then completed a 12-item bogus sentence-unscrambling “language” task (consistent with our cover story).
But that shouldn't make a difference, as all cases are to be judged on their merits, not by the persons who bring them. By law, every federal judge must take an oath affirming to "administer justice without respect to person, and do equal right to the poor and to the rich," and to "faithfully and impartially discharge and perform all the duties incumbent upon me as judge under the Constitution and laws of the United States."

Does Courtroom5 apply to Ilinois ? I’m trying to accept the Judges recommendation fir division of property in a divorce case and avoid trial but my lawyer is trying to go to trial to Tim up the fees … I know I can dismiss lawyer but how do I tell the judge that I want to accept her recommendation for division of property ? Do I 1st file pro se and attach a motion to it simply telling the judge this ? My lawyer is telling me that the judge may not let me out of the case, etc. to discourage me. I need this case to close. No children are involved and this case resulted from a Bifurcated Divorce. I need to get some advice as soon as possible and feel confident about filing the documents. Trial is set for June 2019.

Pro se means that you are representing yourself in court, without a lawyer. Another term is self-represented litigant. If you represent yourself in a family matter, the court will ask you to attend a Pro Se Education Program. The program helps you understand court procedures and the forms you need to file with the court. Classes are free and open to the public.
(2) A judge may serve as an officer, director, active partner, manager, advisor, or employee of a business only if the business is closely held and controlled by members of the judge’s family. For this purpose, “members of the judge’s family” means persons related to the judge or the judge’s spouse within the third degree of relationship as defined in Canon 3C(3)(a), any other relative with whom the judge or the judge’s spouse maintains a close familial relationship, and the spouse of any of the foregoing.
In Faretta v. California,[6] the Supreme Court of the United States held that criminal defendants have a constitutional right to refuse counsel and represent themselves in state criminal proceedings. That said, the right to represent oneself is not absolute. It is the Court's right and duty to determine if a particular individual is capable of representing himself, and can inquire into the individual's lucidity and mental status to make that determination.[7]
