Judges typically have no training in how to cope with unrepresented litigants who may have mental illnesses, or are in the grip of powerful but unfounded feelings that the system is biased and working to hurt them. Unhappy litigants can pose physical danger to judges.23 Handling cases with unrepresented litigants and writing decisions that can be understood by them takes longer, putting pressure on already full workdays. Unrepresented litigants tax the system and the resilience of judges. Stressed out and overwhelmed judges cannot do their work well.24

If you’re a Gangster, you’re almost there. You already have more knowledge, experience, skills and confidence than the lesser types. Just realize that you can’t always win with brute force. Add persuasion to your skill set, and fill gaps in your knowledge of protocol and procedure. That way, you won’t need to rely on brute force. That’s how you become a Conqueror.

Yet the world of the ship is also a land of gab. Conversations and wheeling and dealing break out constantly. There’s a kind of aspirational sociability to life among strangers. It’s always possible that you’re walking into a den of thieves, but it’s more likely that most people are basically decent. If we took a position of total mistrust, we’d all wind up staying in our rooms the whole time to avoid getting fleeced or stabbed. There has to be some baseline level of confidence for exchange to occur, or even for people to just get along and pick up a story or two. Melville’s character hits people where they’re most vulnerable: by trying to act decently, by trying to follow humane norms of behavior, they end up suckers. A minister, for instance, denounces the embittered fellow who says a cripple is an imposter in blackface and gives the beggar a coin (rather than throwing it in his mouth, the cruel sport of the other guests). For his trouble he is rewarded with a visit from a man in gray, who praises him and says, “Since you are of this truly charitable nature, you will not turn away an appeal in behalf of the Seminole Widow and Orphan Asylum?” But the cynics don’t fare any better: a stingy miser buys some herbal concoction in the hope that it will soothe his pain, and a misanthrope who’d rather have machines than boys work his farm agrees to take on a lad from another smooth operator’s Philosophical Intelligence Office, a kind of antebellum temp agency. The confidence-man worms his way into the pockets of trusting and suspicious passengers alike.
The United States ranks an abysmal twenty-five out of thirty-five countries with similar per capita incomes, measured on accessibility and affordability of civil justice in the Rule of Law Index prepared by the World Justice Project.25 The United States consistently fails to provide accessible and adequate legal assistance, and will continue to do so as long as an adversarial system continues and until much more civil legal service funding is provided. Judges foresee the continued erosion of public confidence in the justice system as it becomes increasingly beleaguered by unrepresented litigants, overtaxed courts, and overwhelmed judges.
One limitation of Study 1 is that we did not use a validated measure of state self-compassion, but constructed a composite measure of compassionate feelings using theoretically consistent items available from the administered affect checklist. It is possible that our composite self-compassion measure in Study 1 indexes other constructs besides self-compassion. To address this limitation, we conducted Study 2 to test whether self-affirmation increases self-compassion using a validated behavioral measure of self-compassionate feelings in response to a storytelling task (Leary et al., 2007). Moreover, a limitation of our Study 1 findings, like previous studies (Crocker et al., 2008), is that an alternative compassion explanation can be offered – specifically, it is unclear whether the increase in compassionate feelings in Study 1 are directed toward the self (consistent with our self-compassion account) or toward others (or toward both the self and others). Study 2 directly tests this self vs. other-focused compassion account of self-affirmation by manipulating whether participants provide ratings of their compassionate feelings toward their own storytelling video (self) or to the video of a peer (other). Study 2 also provided an opportunity to extend our self-compassion account by testing the role of trait self-compassion in moderating self-affirmation effects (we did not include a trait self-compassion individual difference measure in Study 1, a study limitation). Specifically, participants in Study 2 completed a measure of trait self-compassion (Neff, 2003b; Raes et al., 2011) to test whether self-affirmation effects on self-compassion are moderated by trait self-compassion, such that self-affirmation increases self-compassionate feelings most in participants who have pre-existing low levels of trait self-compassion.
He convinces the barber to sign a contract agreeing to remove the offending sign and promising to have confidence in people; the confidence-man in turn agrees “to make good to the last any loss that may come from his trusting mankind, in the way of his vocation, for the residue of the present trip.” And then, deal done, he walks out, asking the barber to have confidence that he’ll pay him back for the shave.

Telling someone “Trust me” is usually a dead giveaway that they should do exactly the opposite. A trustworthy person doesn’t need to insist on it. Professions of the need for trust are a pretty good sign that someone is trying to sell you something. Herman Melville’s The Confidence-Man: His Masquerade, the last novel he published in his lifetime, which met with scathing and uncomprehending reviews, plays around with this theme. It’s a disorienting string of loosely connected scenes, tracking the schemes of a shapeshifting trickster aboard a Mississippi steamboat who solicits his fellow passengers through a variety of pitches, always insisting on the need for confidence in the goodness of the world.
"I did not have sexual relations with Monica Lowinsky."  Ms. Lowinsky's allegations involved oral sex.  The definition of sexual relations does NOT include oral sex. President Clinton never denied Ms. Lowinsky's sexual allegation....but millions thought he did!  "There is no improper relationship."  There isn't now, but WAS there?  Many of us are raised speaking and writing without precision. We fill in the gaps with what we believe is the intended meaning.  Precision in the spoken and written word will take time to learn.  
Canon 4B. The changing nature of some organizations and their exposure to litigation make it necessary for a judge regularly to reexamine the activities of each organization with which the judge is affiliated to determine if the judge’s continued association is appropriate. For example, in many jurisdictions, charitable hospitals are in court more often now than in the past.
(C) Fund Raising. A judge may assist nonprofit law-related, civic, charitable, educational, religious, or social organizations in planning fund-raising activities and may be listed as an officer, director, or trustee. A judge may solicit funds for such an organization from judges over whom the judge does not exercise supervisory or appellate authority and from members of the judge’s family. Otherwise, a judge should not personally participate in fund-raising activities, solicit funds for any organization, or use or permit the use of the prestige of judicial office for that purpose. A judge should not personally participate in membership solicitation if the solicitation might reasonably be perceived as coercive or is essentially a fund-raising mechanism.
To avoid this disaster scenario, you should find out early on whether your opponent has the financial wherewithal to pay you if you win. Do some basic online research (e.g., Google, Bing, etc.) and social media (Facebook, Instagram, etc.). Is he employed? Does he drive a nice car? Does he appear to have disposable income (vacations, restaurants, property, possessions)?
Even though it's great to share our goals and aspirations with others--whether they are personal or career-oriented--opening ourselves up to that sense of vulnerability to others subconsciously creates anxiety. Although we may not even realize it, sharing the things you would most like to achieve involuntarily sets expectations for ourselves in the eyes of others--expectations that can often sap your confidence if unmet.

The provisions of this Code should be construed and applied to further that objective.

Settle! Of course, given the unique obstacles involved with litigating against a pro se party—including the absence of the important buffer between the party and his or her emotions and, more times than not, unreasonable expectations—the key to trial success may be avoiding trial altogether! To that end, early alternative dispute resolution proceedings can be exceedingly beneficial. A neutral third party can often insert reasonableness otherwise lacking into the pro se party’s view of the strengths and weaknesses of the case.


The Connecticut Supreme Court narrowed criminal defendant's right to self representation, stating that "we are free to adopt for mentally ill or mentally incapacitated defendants who wish to represent themselves at trial a competency standard that differs from the standard for determining whether such a defendant is competent to stand trial". A Senior Assistant State's Attorney explained that the new standard essentially allows judges to consider whether the defendants are competent enough to perform the skills needed to defend themselves, including composing questions for voir dire and witnesses.[38][39]
